LAWS OUR AGENTS ABIDE BY

The Equality Act 2010

Our officers guarantee impartial and reasonable conduct by not discriminating against customers/people via prejudice or stereotyping.

The Health and Safety at Work Act 1974

Our officers will

(a) take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work*; and

(b) as regards any duty or requirement imposed on his employer or any other person by or under any of the relevant statutory provisions, to co-operate with him so far as is necessary to enable that duty or requirement to be performed or complied with.

*our CCTV operatives will also comply with the Health and Safety Regulations 1992.

The Civil and Criminal Law Act Sec.3 1967
Our officers may use such force only as is reasonable in the circumstances in the prevention of crime, or in effecting or assisting in the lawful arrest of offenders or suspected offenders or of persons unlawfully at large.

The Licensing Act 2003

At licensed premises, our officers pledge to protect children from harm, ensure public safety, prevent crime & disorder, and prevent public nuisance.

(CCTV) The Human Rights Act 1998
Our operators, in relation to the following articles of the HRA,

  • Article 3 - will not use CCTV in a degrading manner

  • Article 5 - will respect a person's right to move around freely

  • Article 6 - will obtain evidence legally

  • Article 8 - will not intrude into a person's private life

  • Article 14 - will not discriminate

(CCTV) The Data Protection Act 2018

Our operators work under the 6 principles of the DPA, which state that data must be

  1. Processed lawfully, fairly, and in a transparent manner;

  2. Collected for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes;

  3. Adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed;

  4. Accurate and, where necessary, kept up to date;

  5. Kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed;

  6. Processed in a manner that ensures appropriate security of the personal data.

(CCTV) The Sexual Offences Act 2003

Our operators vow to abstain from the observation (for the purpose of voyeurism) of another person doing a private act, knowing that the person did not consent to being observed.

(CCTV) The Police and Criminal Evidence Act 1984

To avoid CCTV evidence from being excluded in court, our operators will ensure the correct procedure is followed.

(CCTV) The Regulation of Investigatory Powers Act 2000

If CCTV surveillance is requested in breach of HRA Article 8, our operators will require the necessary authority to be obtained to do so lawfully.

(CCTV) The Criminal Procedure and Investigations Act 1996

If CCTV evidence is requested, our operators will demand the necessary authority before releasing any data in accordance with the Data Protection Act.
